    Bombay High Court rejects ED’s plea in Jet Airways case: Allows police to file closure report

    The central investigation agency was investigating a money laundering case on the basis of an FIR filed against Jet Airways and its promoter Goyals for allegedly cheating a Mumbai-based travel company for over Rs 46 crore.
    The Bombay High Court on Monday rejected the plea of Enforcement Directorate(ED) that had challenged the sessions court ruling of allowing local police to file a closure report in an investigation against Jet Airways and its erstwhile promoters Naresh Goyal and Anita Goyal. The agency had opposed a report filed by MRA Marg Police to file a closure report in a case alleging cheating against the airline as well as Naresh Goyal and his wife Anita.

    The central investigation agency was investigating a money laundering case on the basis of an FIR filed against Jet Airways and its promoter Goyals for allegedly cheating a Mumbai-based travel company for over Rs 46 crore.

    When contacted, Abad Ponda, senior counsel, who was representing Goyals as well as advocate Shriram Sirsath, who appeared along with Anil Singh, additional solicitor general for the ED confirmed the court ruling but refused the divulge anything further since the detailed order was not out yet.

    The case is related to a police complaint filed by the Mumbai-based travel agency Akbar Travels of India (ATIPL), where the travel agency claimed that despite assurance, the company failed to pay it dues of over Rs 46 crore. However, the police had subsequently filed a closure report in the court saying that they did not found any evidence of cheating.

    However, the ED had challenged the closure report and argued that Goyal’s business includes 19 privately held companies out of which five were registered outside India and the promoters may have allegedly used it for money laundering.

    The ED had approached the Magistrate Court and Sessions Court as well to challenge the closure report filed by the MRA Marg Police Station in South Mumbai, where the appeal was rejected. Subsequently, the agency had approached the High Court to challenge the Supreme Court report.
